The Act 256/2022 of 22 June 2022 has amended the Act 251/2012 on energy to define REC and CEC. Provisions are applicable from October 2022. The legal framework has been further clarified by an amendment 363/2022 of 19 October 2022 to the Act 309/2009 on support for renewable energy sources. In light of the latter, the ministry of energy should develop the enabling framework for RECs.

Overall, most provisions specifying the enabling framework for RECs are a copy paste from the EU provisions without further elaboration of concrete measures. Furthermore, there are no specific measures for RECs introduced in the national support scheme for renewables.

Article I(13b)(2e) of the Act 309/2009 (as amended by act 363/2022 of 19 October 2022) mentions that the Ministry will designate a contributory organization within its jurisdiction, which performs the tasks of the contact point for guiding the administrative procedure (hereinafter referred to as the "contact point"). This contact point will provide information regarding the establishment, operation and development of civil energy communities and communities producing energy from renewable energy sources, among others. Also article I(14)(5) states that the Ministry publishes information on its website about support measures for consumers, including low-income consumers, vulnerable consumers, active customers, renewable energy communities, builders, plumbers, architects, suppliers of heating, cooling and electrical equipment and systems, and builders' contractors , installers, architects and suppliers of heating, cooling and electrical equipment and systems and vehicles in which energy from renewable energy sources can be used, for suppliers of vehicles in which energy from renewable sources can be used, and for suppliers of intelligent transport systems.

NECP reporting on enabling frameworks

Not addressed in the transposition. Member States are required via the Governance Regulation (2018/1999) to report on their enabling frameworks for RECs by 15 March 2023.
